Terms of Service – Tair Swisa

By placing an art commission order with me, the Client confirms that they have read, understood, and agreed to all of the Terms of Service outlined in this document.

General

I reserve the right to decline any commission request for any reason.

A place in my commission queue will only be reserved after payment has been received.

Communication will be conducted in Hebrew or English.

By placing an order, the Client confirms that they are at least 18 years old, or have received permission from a parent or legal guardian to place the order.

Subjects I Will Not Draw

I do not accept commissions that include explicit sexual content (NSFW), or any other subject matter that I am not comfortable creating.

Reference Photos

The Client is responsible for providing reference photos of sufficient quality.

The Client confirms that they have permission to use all reference photos submitted for the commission.

I am not responsible for errors or inaccuracies resulting from blurry, incomplete, low-quality, or otherwise insufficient reference photos, including photos that do not clearly show details such as colors, lighting, facial expressions, or angles.

Payment

Payment is accepted via credit/debit card (via a secure payment link) only.

Once the commission details have been confirmed, you will receive a secure payment link to complete your payment.

You may choose either to pay 50% upfront before work begins, with the remaining 50% due before delivery of the artwork or final digital file, or to pay 100% upfront before work begins.

Work will begin only after the initial payment has been received.

The physical artwork or final digital file will only be delivered after full payment has been received.

Cancellations, Refunds, and Chargebacks

Chargebacks (reversing a payment through your credit card company or payment provider) are not permitted. If there is any issue with your commission, please contact me first so we can work toward a solution.

Initiating a chargeback without first attempting to contact me will be considered a violation of these Terms of Service.

If I cancel the commission before I have started working on it, a full refund will be issued.

Once I have started working on the commission, refunds are generally not available, as the artwork is custom-made for the Client. Exceptions apply where required by law or if I cancel the commission.

Revisions

Each commission includes up to 2–3 revisions during the sketch stage.

All significant changes, such as composition, pose, expression, or additional elements, must be requested during this stage.

After the artwork has been completed, up to 2–3 minor revisions may be requested.

Significant changes requested after the sketch has been approved may require an additional fee or may be declined.

Once the Client has approved the sketch or any stage of the artwork, it is the Client's responsibility to ensure that all details are correct. Corrections to details that were not brought to my attention before approval may require an additional fee.

Changes to the Commission

Requests for significant changes after work has begun, such as changing the subject of the artwork, adding characters, changing the composition, or making any other major modifications, may require an additional fee, a revised quote, or may be declined.

Client Responsiveness

If the Client does not respond for 60 days after I have requested information, approval, or feedback necessary to continue the commission, I reserve the right to close the commission.

Any refund, if applicable, will be determined based on the stage of completion of the artwork at that time.

Copyright and Ownership

All copyrights, intellectual property rights, and ownership of the artwork remain exclusively with me, the Artist.

Purchasing an artwork from me does not transfer copyright ownership to the Client.

The Client receives a limited license for personal use only, unless otherwise agreed upon in writing in advance.

Artist's Rights

I reserve the right to display the artwork in my portfolio, publish it on my website and social media, use it as an example of my previous work, unless otherwise agreed upon in writing in advance.

Permitted Use of the Artwork

Unless otherwise agreed upon in writing, the Client may save the artwork on personal devices, print it for personal use only, and share it on social media for personal use only.

The Client may not remove my signature or credit from the artwork when either appears on it.

Prohibited Use of the Artwork

The artwork, in whole or in part, may not be used in any way without my prior express written permission.

This includes, but is not limited to, copying, reproducing, distributing, or selling the artwork, making any commercial use of it, creating derivative works, minting it as an NFT or any similar digital asset, or uploading, using, providing, submitting, or granting access to the artwork for the purpose of training, developing, fine-tuning, testing, or operating artificial intelligence (AI) systems, machine learning systems, or any similar technology.

Any other use that has not been expressly authorized by me in writing is also prohibited.

Completion Time

Completion time varies depending on my workload and the complexity of the commission.

Estimated completion times are provided for reference only and are not guaranteed.

In the event of illness, an emergency, circumstances beyond my control, or other unforeseen events, delays may occur. If this happens, I will notify the Client as soon as reasonably possible.

Delivery

After full payment has been received, the final artwork will be delivered according to the type of commission:

Physical Artwork – Shipping by Mail:
The artwork will be carefully packaged in a manner intended to protect it during shipping. Any applicable shipping costs will be added to the commission price and agreed upon with the Client in advance.

Once the package has been handed over to the postal or shipping service, shipping times and the handling of the package are the responsibility of the relevant postal or shipping service. I will make every reasonable effort to ensure that the artwork is safely and appropriately packaged for shipping.

Physical Artwork – Local Pickup:
Local pickup may be arranged in advance. The artwork will be handed over after full payment has been received.

Digital Artwork:
The final high-resolution file will be delivered to the Client digitally.

Working files, such as PSD, Procreate, or Krita files, are not included in the price unless otherwise agreed upon in writing in advance.
